Welcome to Aloha Functional Medicine and Wellness, PLLC (“Aloha Functional Medicine,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our website, telehealth platform, clinical and non-clinical services, educational materials, social media content, digital programs, communication portals, and any other materials or resources provided by Aloha Functional Medicine and Wellness, PLLC (collectively, the “Services”).

By accessing or using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please discontinue use of our Services immediately.

1. Eligibility & Location Requirements

Our clinical services are available only to individuals who meet all of the following criteria:

  • You are at least 18 years of age;

  • You are a current resident of the State of Texas;

  • You are physically located in the State of Texas at the time of your telehealth appointment, as required by Texas licensing laws.

You understand and acknowledge that if you are not physically present in Texas at the time of your consultation or appointment, we cannot provide medical or clinical services to you.

Non-clinical services (e.g., educational content, general wellness information, social media content) may be available to users outside of Texas, but such material does not constitute medical advice, diagnosis, treatment, or a patient–provider relationship.

2. No Medical Emergencies

Aloha Functional Medicine and Wellness, PLLC does not provide urgent or emergency medical care.You agree that you will not use our Services for emergency medical needs.

If you believe you are experiencing a medical or psychiatric emergency, you must immediately call 911, go to the nearest emergency room, or contact your local emergency services.

3. Nature of Our Services & No Replacement for Primary Care

Aloha Functional Medicine and Wellness, PLLC provides functional medicine services, lifestyle medicine guidance, health coaching, telehealth care, and wellness support. These services are meant to complement but not replace conventional medical care.

You acknowledge and agree that you remain responsible for maintaining all aspects of your general medical care, including but not limited to:

  • Annual physical examinations

  • Routine screenings

  • Prescription medication management

  • Vaccinations and preventive care

  • Urgent, acute, or emergent medical needs

  • Specialty consultations outside our scope

Our services do not establish us as your primary care provider.

4. No Guarantee of Results

You understand that functional medicine focuses on individualized, root-cause assessment. While many clients experience improvement, outcomes vary based on individual circumstances.

Aloha Functional Medicine and Wellness, PLLC cannot and does not guarantee:

  • Symptom changes or resolution

  • A specific timeline of improvement

  • Diagnosis or cure of any condition

  • Prevention of disease

  • Results from any recommended protocol, supplement, or therapeutic intervention

Your progress depends on various factors including lifestyle, genetics, environment, mindset, adherence to recommendations, and external variables.

5. Educational Content Disclaimer

All content provided through our website, social media, blog, emails, digital courses, webinars, guides, or any written or verbal communications is intended solely for informational and educational purposes.

It does not constitute:

  • Medical advice

  • Nursing advice

  • Diagnosis

  • Treatment

  • A patient-provider relationship

  • A substitute for in-person professional evaluation

You agree not to interpret any educational content as medical advice and not to delay seeking professional evaluation based on information from our Services.

6. Telehealth Services Requirements

By using our telehealth Services, you acknowledge and agree that:

  • Telehealth involves using electronic communications to share medical information.

  • You will disclose your true and accurate physical location prior to every visit.

  • Visits will be terminated if you are not located in Texas.

  • There are limitations to telehealth evaluations, including the inability to perform certain physical exams.

  • Technical issues may occur, such as poor connectivity, audio/video problems, or system failures.

  • You are responsible for ensuring privacy on your end (e.g., taking calls in a private location).

  • Telehealth is voluntary and can be discontinued by either party at any time.

7. Privacy, Data Protection & HIPAA

We comply with the Health Insurance Portability and Accountability Act (HIPAA) when handling your Protected Health Information (PHI).

8. Payments, Fees & Refunds

You agree and understand:

  • Payment is due at the time of scheduling.

  • We do not accept insurance of any kind.

  • You may use HSA/FSA funds depending on your plan’s rules.

  • All sales are final once services begin — no refunds.

  • Missed appointments or late cancellations may result in fees as outlined in our cancellation policy.

9. Cancellation & Rescheduling Policy

A minimum of 24 hours’ notice is required to cancel or reschedule your appointment.

Failure to provide notice, or failure to attend your appointment, may result in a fee consistent with our office policies and intake agreement.

10. Client Responsibilities

By using our Services, you agree to:

  • Provide accurate, complete personal and medical information

  • Communicate openly and promptly

  • Follow care recommendations to the best of your ability

  • Notify us of any changes in symptoms or health status

  • Use secure messaging and portals for communication

  • Seek emergency care when necessary

  • Understand that outcomes rely on your participation and lifestyle choices

11. Intellectual Property Rights

All content provided by Aloha Functional Medicine and Wellness, PLLC—including text, graphics, logos, icons, videos, digital products, webinars, guides, branding, and the proprietary ALOHA Method™—is owned by Aloha Functional Medicine and Wellness, PLLC and protected by copyright and trademark law.

You may not copy, reproduce, modify, distribute, or create derivative works without written permission.

12. Website Use & Restrictions

You agree NOT to:
